You may be legally married even though you have agreed to no support at the time of separation. To divorce your spouse, you don't need his consent. A divorce can be obtained by one spouse even though the other does not wish it. A marriage breakup, which must be proven with a one year separation is all that's required for a divorce. This is also known as a "no-fault" divorce. You can get a divorce on grounds such as adultery and cruelty. However, they are rare because these grounds require more evidence that rarely has any effect on the Court's decision. You don't have to wait for one year after separation before filing for divorce. Divorce based upon a marital breakdown may be filed immediately following separation, but it cannot be finalized until after one year. It can be difficult and emotionally draining to separate from your spouse. Singleton & Associates assists with the transition and offers advice. The following are the three reasons you can file for divorce: (1) Living apart and apart for at least one year, (2) Adultery and (3) Cruelty.
