You are still legally married to your spouse until the Court issues a Divorce Order, even if you have been living apart for some time. You can also be legally married if you have not agreed to the spouse receiving any support at the time of separation. You can apply for a divorce without the other spouse’s consent. One spouse can obtain a divorce even if the other spouse does not. Proof of marriage breakdown is needed, which is satisfied when the spouses have been separated for at least a year. This is known as “no-fault” divorce. A divorce application can be filed on the grounds of adultery and cruelty. These claims are less common because they require more proof and the Court gives the same result after a trial as after a hearing. You do not have to wait for one year after your separation to apply for a divorce.
