Every person’s belongings and assets must be ‘collected in’ and distributed according to the deceased person’s will after their death. Where there is no legitimate will, the estate will be shared under the statutory intestacy rules, which define a strict hierarchy of who receives what, beginning with the deceased’s nearest living relatives. We regularly handle estates with complex multi-jurisdictional and cross-border complexities. With our experience in administering estates where assets are located outside Canada and where family members reside outside Canada, we can assist. We also have experience in estate administration where the estate trustees and beneficiaries are in another jurisdiction. The assignment of someone (usually the surviving spouse at first) to control the estate should be done via the court. If there is no spouse, or if they are unwilling or unable to serve, a relative can apply (although only Ontario residents are eligible). If no family members are found, another eligible person can apply to court (e.g. a friend of the deceased, a lawyer, or the Ontario Public Guardian and Trustee).
