Accidents can be both physically and financially devastating. When another party’s negligence has caused you to suffer from a financial or physical loss, Canadian law allows you to recover funds so you can be “made whole” again, or made as close to whole as financial compensation can allow. Pursuing a personal injury case can mean getting help with your medical bills, recovering lost wages and earning capacity, and receiving compensation for the pain and suffering you’ve been through. It can also mean receiving punitive damages when the other party has acted in a grossly negligent or otherwise reprehensible fashion. personal injury cases are complex. Each side is trying to prove the other was primarily the cause of the accident. If the defendant can prove you were the primary reason why the accident happened then they, or more often, their insurance company, won’t have to pay. Failing that, in some provinces, they will try to prove you shared a percentage of negligence since they can reduce your award amount by that percentage. This means after you file a claim there is an extensive process of discovery and investigation that takes place, during which we’re helping to nail down the facts of the case. Once you’ve reached maximum medical improvement it’s possible to calculate the full extent of your damages. We then use your actual loss and the facts of the case to support our position in a settlement conference. 92% of the time, cases settle out of court. Sometimes insurance companies push the matter into court. At that point, we argue your case in front of the jury at trial.

How this Saskatoon long-term disability calculator works

This calculator adds two numbers. Back pay is the monthly benefit your policy should have paid (capped at the policy maximum if it has one, less any CPP-D or WCB offset) multiplied by the months it has been unpaid. Benefits only start after your policy's waiting (elimination) period, so count unpaid months from the end of that period. Future benefits are the same monthly amount until your policy's end age (usually 65), converted to today's value with a discount rate. Insurers rarely pay the full future value in a lump sum, so the estimate also shows the range buyouts typically land in, which depends on whether you are still being paid, were cut off, or were denied from the start. If your benefit is taxable, it also shows roughly what you keep each month after tax.

Saskatchewan rules this calculator applies

Deadline to act
Generally 2 years from discovery (The Limitations Act). Check your policy for a shorter period. An internal appeal to the insurer does NOT stop the limitation clock.
Discount rate
Future benefits are discounted at 3.5%, the rate disability lawyers commonly use to value LTD claims. If your benefit has a cost-of-living adjustment (COLA), the calculator uses 1.5% instead: your payments grow with inflation, so less is taken off for the time value of money.
Typical buyout range
Published lump-sum settlements land at about 50–75% of the present value of future benefits when the claim is being paid, 40–70% after benefits are cut off, and 30–60% when the claim was denied from the start. Back pay is added on top.
CPP-D offset
Most group policies reduce your LTD benefit by any CPP Disability you receive (about $1,236 a month on average in 2026). WCB / WorkSafe benefits are usually deducted too.
Tax
If your employer paid any part of the premiums, monthly LTD benefits are taxable. In a lump-sum settlement of a denied claim, the back-pay portion is usually taxable and the future portion often is not, so how the settlement is split matters. Get tax advice before you sign.
Extra damages
Canadian courts can add damages for mental distress caused by a wrongful denial (Fidler v. Sun Life, 2006 SCC 30) and, rarely, punitive damages for bad faith (Whiten v. Pilot, 2002 SCC 18). These are seldom part of a settlement and are not in this estimate.
Recovery and life expectancy
Insurers rarely pay every month to the end date: they will argue you may recover or that your condition shortens your life expectancy. These arguments are complex and differ case by case, so have a lawyer assess how they apply to you.
Union members
If you are in a union, your collective agreement may require you to use the grievance process instead of suing when your LTD is denied. An experienced disability lawyer can tell you which route applies.

General information about Saskatchewan disability insurance law, not legal or tax advice. The estimate is not a guarantee: your policy wording, medical evidence, offsets and the insurer's position all change the answer. A disability lawyer can tell you how these rules apply to you.

Frequently asked questions

9 questions
How does the long-term disability settlement calculator work?
The calculator estimates back pay and future benefits based on claim status, policy type, monthly benefit, CPP-D offset, age, and months unpaid. It uses a 3% discount rate for future benefits.
What is a long-term disability buyout in Saskatchewan?
A buyout is a lump-sum settlement offered instead of ongoing monthly benefits. It typically ranges from 30-75% of future benefits' present value, depending on claim status.
Why might my LTD settlement be less than full value?
Settlements often reflect a percentage of future benefits' present value, factoring in risks and uncertainties. Typical ranges are 30-75% based on claim status.
What if my long-term disability claim is denied in Saskatchewan?
If denied, you can appeal or negotiate a settlement. Denied claims may settle for 30-60% of future benefits' present value, plus back pay.
What is the deadline to sue for LTD in Saskatchewan?
The general deadline is 2 years from discovery under The Limitations Act. Check your policy for a shorter period.
Are lump-sum LTD settlements taxable in Saskatchewan?
If your employer paid premiums, monthly benefits are taxable. In denied claims, back pay is usually taxable, but future portions often are not. Seek tax advice.
What is the 'own occupation' vs 'any occupation' test in LTD policies?
Most LTD policies switch from an 'own occupation' to an 'any occupation' test after 24 months, affecting eligibility for ongoing benefits.
How accurate is the Saskatoon LTD settlement calculator?
The calculator provides estimates based on typical ranges and assumptions. Actual settlements depend on individual circumstances and negotiations.
Can I get damages for mental distress if my LTD claim is denied?
Canadian courts may award damages for mental distress in wrongful denials, but these are rarely part of settlements and not included in estimates.
