A trust document is a legally binding agreement that allows its creator (also known as the settlor or trustor) to transfer particular assets to a trustee while they are still alive. The trustor can transfer these assets to specific beneficiaries within the trust. When the trustor dies, the trustee distributes the assets in line with the conditions established in the trust. Trusts are preferred to wills because they circumvent the probate process, which estates must endure. When a will goes through probate, it has to be "proven" by the judge. The probate court uses this time to evaluate and account for the assets. After all debts are paid, the assets are allocated to beneficiaries. Probate is accompanied by court costs and often attorney fees. This whole process may last up to a year. When a will is probated, anyone can see it. The trust, however, remains private after your death and does not need to be probated since the ownership is already in the trustee's name. You can also adjust your trust during your lifetime, such as moving assets, adding beneficiaries, or changing the trust to another trustee's name.
