I am proud to have earned the American Trial Lawyers for Public Justice Trial Lawyer of the Year award for 1994 after discovering and exposing the Tucson Police Department strategy of non-consensual questioning of suspects. The citation is Cooper v. Dupnik, 963 F.2d 1220 (9th Cir. 1992). I engaged in various RBT cases in Arizona, the most significant being the challenge to it, which resulted in 14,000 breath test results being thrown out. The citation to that case is State v. Fields 196 Ariz. 580 (2 P.3d 670) (Div. 2 1999). Recently, I was co-counsel in the case State v. Gibson. The trial court ruled that the State could not use its experts in arson cases. The court ruled that the experts were not compliant with Daubert/Rule 702, a judgment based on the evidence being inconsistent and unreliable. This is the first scenario in America wherein government experts in arson cases were barred from testifying.
