Eldessouky law at (714) 409-8991 provides representation to individuals who are disabled and have suffered workplace discrimination. It is a sad fact that workplace discrimination can take many forms. This type of mistreatment is especially dangerous in the workplace. To help you take proactive measures to safeguard your legal rights, here are some facts and figures about disability discrimination. Discrimination in the workplace is when workers are treated differently or unfairly because they have a disability. This is legally known as discrimination at work for a worker who experiences disparate, or even negative treatment because of a mental or physical disability. It is against the law to unfairly treat an employee because they have a disability. Employees with a history or disability (e.g., cancer in remission) are also protected. The law also protects employees who are married to someone with a disability.

This calculator adds two numbers. Back pay is the monthly benefit your policy should have paid (after any SSDI offset) multiplied by the months it has been unpaid. Future benefits are the same monthly amount until benefits normally end at age 65, converted to today's value with a discount rate. Insurers rarely pay the full future value in a lump sum, so the estimate also shows the range buyouts typically land in, which depends on whether you are still being paid, were cut off, or were denied from the start.
General information about California disability insurance law, not legal or tax advice. The estimate is not a guarantee: your policy wording, medical evidence, offsets and the insurer's position all change the answer. A disability lawyer can tell you how these rules apply to you.
