The general issue in this appeal was whether the District Court had honored the judgment of the Supreme Court or had instead enforced an unconstitutional criminal prosecution by secretly sealing the Supreme Court case after reversing? The general issue was whether the Federal Circuit had issued an unconstitutional court decision by granting the Appellees' motion for summary judgment on the merits, after also granting CD's United's motion to file a Federal Circuit summons as a criminal prosecution. CD's United had moved for a Federal Circuit Summons, which the Ninth Court of Appeals granted on the grounds that it would help their case against the Plaintiff. CD's United had also filed a petition for a writ of certiorari in the Ninth Court of Appeals, asking the Ninth Circuit to enjoin the District Court from proceeding any further regarding CD's United's lawsuit against Acco Brands. In addition, CD's United's motion for preliminary injunctive relief was granted by the District Court, but all further actions were stayed after the Federal Circuit granted CD's United's Petition for a Federal Circuit Summons. The general issue was whether the Federal Circuit had issued an unconstitutional court decision by granting the Appellees' Motion for Summary Judgment on the merits it needs to be more detailed than that, the woman said. Although she could not provide any supporting evidence sinc=is a heresay or appeared unprofessional, the attorney responded that he had notified his supervisor and was hopeful that he would get the lien removed. He then attached a message to the District Court Clerk after the pleading was filed in the Ninth Court of Appeals that the Federal District Court Clerk had notified him that nothing could be done since it was a state court case and that she had attached a copy of the Ninth Court of Appeals' judgment from a case filed in 1991. The woman was confused when she asked the lawyer if they were appealing the judgment of the Ninth Circuit. The attorney responded TO: The District Court Clerk, The Honorable et al Please let me know if the above exhibits are sufficient to satisfy the requirements of the amendment to the order, that was based on the filing of the amended petition for a writ of certiorari, strongly and clearly supporting the Plaintiff's case (and showing the federal appeals court judgment). KINDLY RESPOND AT YOUR EARLIEST CONVENIENCE SINCE THE COMPLAINT HAS BEEN PLACED ON THE COURT'S DOCKET AS OF 9:30AM. Respectfully, The Director The woman was confused when she asked the lawyer if they were appealing the judgment of the Ninth Circuit. The attorney responded, "I don't know which judgment you are referring to. The Attorney provided the Ninth Circuit's decision file and the Notice of Appeal "Upon review of the case file, it is determined that the Plaintiff's requests are the result of an unknowingly confused understanding of the judgment from the Ninth Circuit." In addition, CD's United had also filed a Petitioner's Brief, in which CD's United argued that the First Amended Order was incorrect in stating that the Federal Circuit had ruled in favor of the Plaintiff. The supplemental record from the Federal Circuit, which had been filed on August 14th, 2021 in support of the pleadings from the Federal Circuit, contained the information needed for the Ninth Circuit Clerk's information. After being presented with the Department of Appeals judgment, the woman was speechless for a while, after which she expressed her gratitude to the Federal Circuit Court for such a generous opinion. She promised to personally make arrangements to hand the attorneys a token of appreciation to show good faith and hopes that the Ninth Circuit can provide a judgment in this appeal that will honor the Federal Circuit Court's decision.
