The probate process must be followed exactly after death to settle an estate. The person''s Last Will and Testament is submitted to the Probate Court. If the deceased person has no assets, this is the only document required. However, if they have assets, it will be submitted with other documentation, including a form for Probate. If no waivers have been filed with the Court, the Court usually schedules a hearing to determine the validity of the will and the appointment of the Executor. The Court will notify all beneficiaries, including close relatives. Any beneficiary can then appear to contest the proposed actions. Once appointed, the Executor will start the process of gathering the assets and notifying the creditors. The Executor files an inventory of assets owned by only one person or with the deceased in the public such as a bank account (Banks) with the Court. There is more to do, including clauses that could be in the Last Will and Testament. In 9-18 months the executor is ready to close an estate. At that point, the executor files a proposed Accounting with the Court. According to the Last Will and Testament, this will identify which assets are to be transferred to the beneficiaries. This Accounting must be approved by the Court before it can be distributed.
