ABOUT   Services Excellence Summary

Will Deposited and Recorded with the Clerk of Court Frank J. Pyle Florida Probate & Trust Attorney 1326 S Pine Ave. Ocala, Florida 34471 (352) 266-0020 Too often, the original will with original signatures is erroneously placed in a safe deposit box in the decedent's name. One would think that would be the best place to put it, but it is most definitely not.  Please keep the original will with original signatures either in a locked fireproof box at home where it can be easily accessed or in a safe place with someone you trust. The original will with original signatures should be deposited and recorded with the Clerk of Court in the county where the decedent lived. Florida law sets the default rules for how the decedent's property will be distributed if he or she dies without a will.  If the decedent owned real estate outside of Florida, a certified copy of the Will or the probate proceeding from that state should be requested. Some states also have statutes that allow a will from another state to be filed in their probate court without the need for an actual probate proceeding. Many wills have a "self-proving" affidavit that attests to the authenticity of the signatures. Probate courts often verify this before admitting it to probate. If the self-proving affidavit is present, the court will usually not ask for more documentation. Otherwise, the court may ask for proof that the witnesses actually signed the will. Unsecured creditors often have preferred claims. These are generally initially claims for medical bills, credit card debts, unsecured loans, and medical bills. Unsecured creditors generally have lower claims than secured creditors such as a mortgage or car loan, but they have more rights than non-creditors. These are often overlooked rights. If you do not ask at the proper time, you will be denied these rights. The personal representative is often called the executor of the estate. Under Florida law, the personal representative may serve or sign a pleading attesting to the fact that administration has been completed. It should also request that the personal representative be discharged. All interested parties should be served.
