Depiction of the Court Probate Process A probate court is responsible for and must follow specific guidelines to make sure that the process goes smoothly and the property transfers are legal. The court must fulfill these probate processes such as: identifying the deceased individual’s property (also referred to as the decedent); bringing them together; repaying decedent’s debts; and issuing assets to beneficiaries of the decedent. In Florida, a will must be deposited with the probate court no later than 10 days after knowing of the deceased person’s death. These individuals typically receive the notifications: members of the family, health-care providers, hospice, and healthcare staff, etc. A fee is not charged to the county clerk to deposit a will, however, a fee is required to start up a probate case.
