About this business
Estate Planning Group
Estate Planning Group, as an essence, is a simple statement that encapsulates our services. Essentially, a Hawaii probate involves distributing your assets post probate administration expenses and debt liabilities. It is a misconception that a will can be used to avoid probate. A will cannot generally avert probate. Probate is mandatory for the distribution of assets to the entitled parties, whether or not you have a will. The difference, if you have a Will and do not have a Will (i.e. intestate) is mainly that with a WILL, you can: (i.) select the person responsible for administering your estate, known as the Personal Representative, (ii.) select the people to whom your assets will be distributed post-probate (these are referred to as Beneficiaries), and (iii.) designate a guardian for a minor child. If you die without a will, Hawaii law defines your Personal Representative, your Beneficiaries, and if a separate court proceeding is started to establish a guardian for minor children.
