About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under North Carolina law.

North Carolina rules this calculator applies

Fault rule
Contributory negligence. One of the strictest rules in the country: if you were even 1% at fault, you may recover nothing. A lawyer matters more here than anywhere.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in North Carolina. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about North Carolina law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

9 questions
How does the car accident settlement calculator work?
It estimates economic damages and pain and suffering using a multiplier on medical costs, adjusted for accident type and fault under North Carolina law.
How accurate is a car accident settlement calculator?
Calculators provide a general estimate. Actual settlements depend on detailed case facts, legal representation, and negotiations.
What factors can increase my car accident settlement?
Higher medical costs, lost wages, and severe injuries can increase settlements. Fault and contributory negligence rules in North Carolina can reduce them.
How is pain and suffering calculated in Charlotte?
Pain and suffering are estimated using a multiplier of 1.5 to 5 on medical costs, based on injury severity.
What is North Carolina's fault rule for car accidents?
North Carolina uses contributory negligence, meaning if you're even 1% at fault, you may recover nothing.
Should I accept the insurance company's first settlement offer?
It's often advised to consult with a lawyer before accepting any offer, as initial offers may be low.
How long does it take to settle a car accident claim?
Settlement times vary based on case complexity, negotiations, and court schedules, often taking months to years.
What medical documentation is important for my claim?
Medical bills, treatment records, and doctor's notes are crucial for documenting injuries and calculating damages.
How do lawyer fees impact my car accident settlement?
Lawyer fees, often 33% to 40% of the settlement, are deducted from the total amount recovered.
