Where to begin? I suppose with the fact that in all of my years this was the most bungling and incompetent/professionally negligent law firm I have ever used. I was in an automobile accident nearly four months ago I and I retained Riddle to represent me. From the start communication was slow to then…

About this Car Accident Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under North Carolina law.

North Carolina rules this calculator applies

Fault rule
Contributory negligence. One of the strictest rules in the country: if you were even 1% at fault, you may recover nothing. A lawyer matters more here than anywhere.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in North Carolina. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about North Carolina law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

Pain and suffering is estimated using a multiplier of 1.5 to 5 on medical costs, depending on injury severity. This is part of the settlement range.
Should I accept the first settlement offer from an insurer?
Insurers often start with low offers. Consider consulting a lawyer to evaluate if the offer reflects your damages and North Carolina's strict fault rules.
What is the deadline for filing a car accident claim in North Carolina?
You have 3 years from the date of injury to file a personal injury claim. Different deadlines apply for claims against government bodies or specific cases.
How long does it take to settle a car accident claim in Raleigh?
Settlement times vary widely. Factors include case complexity, negotiation length, and court schedules. Consult a lawyer for a more precise timeline.
What medical documentation is important for my car accident claim?
Medical bills, treatment records, and doctor’s notes are crucial for proving damages and calculating settlement amounts. Keep all related documents organized.
How do lawyer fees affect my car accident settlement in North Carolina?
Lawyer fees, typically 33% to 40% of the settlement, are deducted from your award. Free consultations are common to discuss potential outcomes.
What factors are specific to Raleigh that could affect my settlement?
Local factors like traffic patterns and cost of living can influence economic damages. Raleigh's court schedules may also impact settlement timelines.
