We are dedicated to assisting disabled individuals and their families in their pursuit of Social Security, Veterans, and Private Disability Benefits. We have personally appeared with hundreds of clients at their Social Security and VA Disability Hearings throughout the United States. Most people think of Social Security as a program for retirees. In fact, the Social Security Administration has a substantial program of benefits for disabled individuals. When an adult cannot work due to an injury and/or medical condition, she/he may be eligible for financial benefits under the SSDI and/or SSI programs provided through the Social Security Act. There are also provisions for children who have severe limitations.

How this Jersey City long-term disability calculator works

This calculator adds two numbers. Back pay is the monthly benefit your policy should have paid (after any SSDI offset) multiplied by the months it has been unpaid. Future benefits are the same monthly amount until benefits normally end at age 65, converted to today's value with a discount rate. Insurers rarely pay the full future value in a lump sum, so the estimate also shows the range buyouts typically land in, which depends on whether you are still being paid, were cut off, or were denied from the start.

New Jersey rules this calculator applies

Deadline to act
For an ERISA employer plan, file your internal appeal within 180 days of the denial letter; you cannot sue until it is decided.
Discount rate
Future benefits are discounted at 3%, a common buyout assumption.
Typical buyout range
Published lump-sum settlements land at about 50–75% of the present value of future benefits when the claim is being paid, 40–70% after benefits are cut off, and 30–60% when the claim was denied from the start. Back pay is added on top.
SSDI offset
Most employer plans reduce your LTD benefit by any Social Security Disability (SSDI) you receive (about $1,630 a month on average in 2026).
Tax
If your employer paid the premiums, or you paid them with pre-tax dollars, LTD benefits and settlements are taxable income. If you paid with after-tax money, they are generally not. Get tax advice before you sign.
ERISA plans
Most employer plans are governed by ERISA: you must file an internal appeal within 180 days of the denial before you can sue, the insurer usually has 45 days (plus one 45-day extension) to decide, and the case is then heard by a judge on the written record. ERISA allows back benefits, reinstatement and attorney fees, but no jury and no punitive or emotional-distress damages. Individual, government and church plans fall outside ERISA, so state law applies: you can usually sue in state court, and bad-faith damages may be available.

General information about New Jersey disability insurance law, not legal or tax advice. The estimate is not a guarantee: your policy wording, medical evidence, offsets and the insurer's position all change the answer. A disability lawyer can tell you how these rules apply to you.

Frequently asked questions

10 questions
How does the long-term disability settlement calculator work?
The calculator estimates back pay owed, future benefits to age 65, their present value, and a typical lump-sum settlement range based on your claim status and policy details.
What if my long-term disability claim was denied in New Jersey?
Under ERISA, you must file an internal appeal within 180 days. If denied again, you can sue. State law applies if your plan isn't under ERISA.
How accurate is the long-term disability settlement estimate?
Estimates are based on typical published ranges and your specific inputs. They are not guarantees but provide a general idea of potential outcomes.
What is a long-term disability buyout?
A buyout is a lump-sum settlement offered by insurers to resolve future benefits. It typically ranges from 30-75% of the present value of future benefits.
Why are long-term disability settlements below full value?
Settlements reflect a compromise, considering the uncertainty of future benefits, potential offsets, and legal costs. They typically range from 30-75% of future benefits' present value.
What is the ERISA appeal process for long-term disability?
Under ERISA, file an internal appeal within 180 days of denial. The insurer usually decides within 45 days, with a possible 45-day extension.
How does SSDI offset affect my long-term disability benefits?
Most LTD policies reduce benefits by any SSDI received. This offset can lower your monthly LTD payments but increases the potential back pay owed.
Is a lump-sum long-term disability settlement taxable in New Jersey?
If premiums were employer-paid or pre-tax, settlements are taxable. If paid with after-tax dollars, they generally aren't. Seek tax advice before signing.
What is the 'own occupation' vs 'any occupation' test in LTD policies?
Most LTD policies switch from 'own occupation' to 'any occupation' after 24 months, impacting eligibility for continued benefits.
How is a Jersey City long-term disability settlement calculated?
The calculator uses claim status, policy type, monthly benefit, SSDI offset, age, and months unpaid to estimate back pay and future benefits.
