Child custody agreements can be modified in New Mexico after a divorce has been filed. The original decree was passed and requires evidence. New Mexico law presumes that shared custody is the best option for the children. This does not mean that custody or visitation must be split evenly. If you have changed circumstances and want to change your custody agreement, you will need to file a petition to do so. In New Mexico, you can file for a fault-based or no-fault divorce. New Mexico recognises fault-based reasons for divorce, such as infidelity, cruelty, or abandonment. A no-fault divorce also states that the relationship is "irreparably" broken. When possible, we encourage mediation, as it is more equitable and less stressful. Mediation allows both spouses to express their views and have a say in the settlement.
