Alimony/Maintenance/Spousal Maintenance The law establishes alimony and is also known as maintenance or spousal support as an obligation because during the marriage, spouses are considered to be responsible for one another and even after the marriage ends. After the divorce proceedings have started, any party can request the court to order the other party to provide financial support. The amounts and conditions of alimony vary significantly depending on the facts of each party, including the parties' current and potential earnings, the duration of the marriage, the inheritance, the value of the marital estate, the earning capacity, age, health, and other factors. The support may continue or even not continue if one party does not have enough funds at the time the divorce is finalized. Even if the divorcing parties do not reach an agreement in a signed, written document, the court may still establish the alimony obligation. The court can modify this order at any point if the circumstances of one or both parties change.
