About this Personal Injury Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Virginia law.

Virginia rules this calculator applies

Fault rule
Contributory negligence. One of the strictest rules in the country: if you were even 1% at fault, you may recover nothing. A lawyer matters more here than anywhere.
Deadline to file
You generally have 2 years from the date of the injury to file a personal injury claim in Virginia. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about Virginia law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

The calculator provides a general estimate based on available data. Actual settlements can vary due to unique case factors and Virginia's contributory negligence rule.
What factors can increase my personal injury settlement in Ashburn?
Higher medical costs, significant lost wages, and severe injuries typically increase settlements. Pain and suffering are valued with a multiplier based on injury severity.
How does Virginia's fault rule affect my settlement estimate?
Virginia's contributory negligence rule means if you're even 1% at fault, you may recover nothing. This strict rule significantly impacts settlement outcomes.
What is the deadline to file a personal injury claim in Virginia?
You have 2 years from the injury date to file a personal injury claim in Virginia. Different rules apply for claims against government bodies or medical malpractice.
Should I accept the insurance company's first settlement offer?
First offers are often low. Consider consulting a lawyer before accepting to ensure the offer reflects your damages and Virginia's strict fault rules.
How long do personal injury settlements typically take in Ashburn?
Settlement timelines vary widely. Factors include case complexity, negotiation length, and court schedules. Consult a lawyer for a more precise estimate.
What medical documentation is important for my personal injury claim?
Medical bills, treatment records, and doctor's notes are crucial. They substantiate your injury severity and treatment costs, impacting your settlement value.
How do lawyer fees affect my personal injury settlement amount in Virginia?
Lawyer fees, usually 33% to 40% of the settlement, are deducted from your total award. Free consultations are common to discuss potential costs and outcomes.

Local factors like traffic patterns and cost of living can influence settlement values. These may affect economic damages like lost wages and medical costs.
