About this Personal Injury Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Washington law.

Washington rules this calculator applies

Fault rule
Pure comparative fault. Your payout drops by your share of fault, but you can still recover even if you were mostly at fault.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in Washington. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about Washington law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

9 questions
How is my personal injury settlement calculated in Edmonds?
The calculator estimates economic damages (medical bills, lost wages) plus pain and suffering. It applies a multiplier of 1.5 to 5 on medical costs, adjusted for accident type.
What factors affect my settlement amount in Washington?
Factors include medical expenses, lost wages, accident type, and your share of fault. Pain and suffering are valued with a multiplier based on injury severity.
How does Washington's comparative negligence rule impact my settlement?
Your settlement decreases by your percentage of fault. You can still recover damages even if mostly at fault, under Washington's pure comparative fault rule.
What is the statute of limitations for personal injury claims in Washington?
You have 3 years from the injury date to file a general negligence claim. Different deadlines apply for government claims, medical malpractice, and wrongful death.
Should I accept the first settlement offer from an insurer?
Insurers often offer less initially. Consider consulting a lawyer to evaluate if the offer covers all your damages and future needs.
How long does it typically take to settle a personal injury claim?
Settlement times vary. Simple cases may resolve in months, while complex ones can take years. Documentation and negotiations impact timelines.
What medical documentation is important for my injury claim?
Keep all medical bills, treatment records, and doctor’s notes. They substantiate your injury severity and treatment costs, crucial for calculating damages.
How do lawyer fees affect my net settlement amount?
Lawyers typically work on contingency, taking 33% to 40% of the settlement. This fee is deducted from your total award, affecting your net amount.
Are there specific factors in Edmonds affecting personal injury settlements?
While Edmonds-specific factors like local traffic patterns may influence accidents, settlements primarily depend on state laws and individual case details.
