About this Personal Injury Settlement Calculator

Canadian courts do not use the multiplier method. This calculator adds your financial losses (treatment and care costs, and lost income) to a pain-and-suffering range for your level of injury, based on typical Canadian awards: about $5,000 to $40,000 for minor injuries, $50,000 to $150,000 for moderate ones, $150,000 to $350,000 for serious permanent injuries, and up to the national cap of about $470,000 for catastrophic ones. The total is then reduced by your share of fault under British Columbia law.

Shared fault (apportionment). Your payout drops by your share of fault, but being partly at fault never bars your claim.
Pain and suffering cap
About $470,000 anywhere in Canada, reserved for the most catastrophic injuries (the Supreme Court of Canada cap, indexed for inflation).
Deadline to file
Generally 2 years from when you knew, or ought to have known, about the injury and its cause. Claims against a municipality or other public body often need written notice much sooner.

Car accidents in British Columbia

Since May 1, 2021, injuries from a vehicle crash in British Columbia are covered by ICBC Enhanced Care benefits instead of a lawsuit, whoever caused it. The exception: if the at-fault driver is convicted of certain Criminal Code offences, such as impaired driving, you can still sue them.

This applies to anyone hurt in a crash involving a vehicle, including pedestrians, cyclists and passengers. Slip and fall, dog bite, medical malpractice and other injuries follow the ordinary rules above.
