David R. Melvin is a lawyer who works with his partners at Weldon McInnis in Dartmouth. We offer guidance in real estate law, commercial and corporate law, personal directives and enduring powers of attorney for property, as well as probate and estate matters. We serve the Halifax Regional Municipality and all of Nova Scotia. Our clients are small and medium-sized businesses, families, financial institutions, and more. When someone dies, whatever they own has to be dealt with, including who gets what. Whoever is handling the estate of the dead person has to do things like find and collect any money or property, pay off debts that the person owed, and then give the remaining money to the people who are meant to get it. This might be what the dead person said in a will, or else it is what the law says which people should get the money or property. The person handling the estate will often need a grant from the Probate Court of Nova Scotia to let them do this work. Where a person owns real estate or is a joint tenant, they will need a grant. Other times they will need a grant to deal with assets held by financial institutions in the dead person’s name, or when there is a disagreement about the person’s will. The grant proves that the named person is allowed to handle the assets, pay off debts and pass the money to the people it is meant to go to.
