If a person dies without a valid will, the deceased's estate is divided pursuant to the provincial laws that state who applies to be appointed Executor, what the succession plan is, among other things. This may include the need to consent to applications for probate and may require a new application process where necessary. This process can be time-consuming and expensive, so it may be better to make your wishes known in writing. It is essential to consult a lawyer who specializes in this area of the law if you are acting as a Personal Representative/Executor or Administrator for an estate.
