What Is a Will? A will is a legal document that describes a person's desires and directions for their property management and distribution to beneficiaries. A person's estate is their total assets and any other debts at death. How Does a Will Function? A Will determines an estate trustee to take over the deceased's responsibilities. The Estate Trustee settles the estate's debts and collects all property for distribution to all beneficiaries per the will. The Will includes all beneficiaries and the kind of interest they will acquire. In case you have minor children, you must include a Guardianship clause in your Will. The Guardianship clause names the person who is to take care and supervise the minor children when one parent dies or is incapacitated. What If There Isn't a Will? Without a Will, a court will not divide a person's assets. According to the Succession Law Reform Act (R.S.O. 1990, c. S. 26), the estate will pass to blood relatives under intestacy law. Is Making a Will Necessary? A valid Will is always necessary to avoid problems during the Estate Administration. Suppose a spouse dies without a Will and leaves a child. In this case, the child will own a portion of the deceased spouse's property because the intestacy law will provide for the child. In instances where there is no Will, the Office of the Children's Lawyer may take over the child's estate. This example shows unnecessary expenses and unnecessary complexity in a relatively simple estate. Make a valid Last Will and Testament to avoid such confusion. Must I Make a Will? If you are in common-law relationships, you must make a will to avoid unnecessary complications. Suppose a couple lived together for thirty years and had two children. Suppose they were not married. In this case, the surviving spouse will not inherit the deceased's property when one of them dies. In legal language, a "spouse" is only married couples. Common-law partners are unmarried. With a valid Will, the common-law spouse could file an application as a dependent for financial support from the deceased spouse's estate. A Will is a good planning tool and should be made when possible. Properly made Wills help you organize your things and ease the distribution of your estate.
