How this Toronto long-term disability calculator works

This calculator adds two numbers. Back pay is the monthly benefit your policy should have paid (after any CPP-D offset) multiplied by the months it has been unpaid. Future benefits are the same monthly amount until benefits normally end at age 65, converted to today's value with a discount rate. Insurers rarely pay the full future value in a lump sum, so the estimate also shows the range buyouts typically land in, which depends on whether you are still being paid, were cut off, or were denied from the start.

Ontario rules this calculator applies

Deadline to act
Generally 2 years from discovery (Limitations Act, 2002), often counted from when benefits stopped or were first payable (Clarke v. Sun Life, 2020 ONCA 11). An internal appeal may not pause the clock.
Discount rate
Future benefits are discounted at 1.2% for the first 15 years and 2.5% after (Ontario Rule 53.09, 2026).
Typical buyout range
Published lump-sum settlements land at about 50–75% of the present value of future benefits when the claim is being paid, 40–70% after benefits are cut off, and 30–60% when the claim was denied from the start. Back pay is added on top.
CPP-D offset
Most group policies reduce your LTD benefit by any CPP Disability you receive (about $1,236 a month on average in 2026).
Tax
If your employer paid any part of the premiums, monthly LTD benefits are taxable. In a lump-sum settlement of a denied claim, the back-pay portion is usually taxable and the future portion often is not, so how the settlement is split matters. Get tax advice before you sign.
Extra damages
Canadian courts can add damages for mental distress caused by a wrongful denial (Fidler v. Sun Life, 2006 SCC 30) and, rarely, punitive damages for bad faith (Whiten v. Pilot, 2002 SCC 18). These are seldom part of a settlement and are not in this estimate.

General information about Ontario disability insurance law, not legal or tax advice. The estimate is not a guarantee: your policy wording, medical evidence, offsets and the insurer's position all change the answer. A disability lawyer can tell you how these rules apply to you.

Frequently asked questions

9 questions
How does the long-term disability settlement calculator work?
It estimates back pay, future benefits to age 65, their present value, and a typical lump-sum settlement range based on your claim status, policy, and other inputs.
How accurate is the LTD settlement estimate for Toronto?
The estimate uses typical ranges for lump-sum buyouts and considers Ontario-specific factors like discount rates and CPP-D offsets. It's a general guide, not a guarantee.
What is the deadline to sue if my LTD claim is denied in Ontario?
Generally, you have 2 years from when benefits stopped or were first payable, as per the Limitations Act, 2002. Internal appeals may not pause this deadline.
How are back pay and future benefits calculated in an LTD claim?
Back pay is the unpaid amount from when benefits stopped. Future benefits are projected to age 65, discounted to present value using Ontario's rates.
What is a long-term disability buyout?
A buyout is a lump-sum payment to settle your claim. It's typically 30-75% of future benefits' present value, plus back pay, depending on claim status.
Why are LTD settlements below full value?
Settlements account for risk, time value of money, and negotiation factors. They typically range from 30-75% of future benefits' present value.
How does CPP Disability affect my LTD benefits?
Most LTD policies reduce your benefit by any CPP Disability received. This offset impacts both monthly benefits and settlement calculations.
Is a lump-sum LTD settlement taxable in Ontario?
If employer-paid, monthly benefits are taxable. In settlements, back pay is usually taxable, but future portions often aren't. Consult a tax advisor.
What is the own-occupation vs any-occupation test in LTD policies?
Most policies switch from an 'own occupation' to an 'any occupation' test after 24 months, affecting eligibility for ongoing benefits.
