How We Start …. When we first meet with you and you decide to hire our firm, we will send a letter to your spouse or their lawyer to let them know that you want to negotiate a separation agreement. Financial information must be exchanged between clients and their spouses (with their spouses' lawyers if their spouses have lawyers) so that both parties and both lawyers are aware of the other's financial situation. The purpose of this is to establish a basis for dividing assets and determining spousal and child support. This exchange is also necessary to prepare an agreement that will be acceptable to the other spouse, so a separation agreement can be negotiated. Creating the Separation Agreement …. A separation agreement is a legal document signed by both spouses that sets out their legal rights concerning their children, division of property, child support, and spousal support if any. This document will be relied on for years to come and is binding on both spouses, so it is critical that it be correct. If you can agree on all these things, there is no need to go to court. You only need to go to court if there are issues that cannot be resolved any other way. If financial issues cannot be resolved and are in dispute, you will also have to prepare, file and serve the court with a Financial Statement on your spouse. The Financial Statement sets out your income and expenses, and your assets and liabilities, so the other side knows what your financial position is. This is a pretrial step, and all of these documents are exchanged so that both parties can prepare for trial. Our office will assist you in collecting the information required to include these legal papers and we will prepare these papers for you and make sure that you assert all the claims you are entitled to. When all the papers are completed, we will arrange for them to be filed and served on your spouse.
