ABOUT   Services Excellence Summary

Moore Family Law Group puts your physical, mental and emotional well-being first. We aim to help you navigate challenging times, allowing you to focus on your family. A brief outline of California's divorce process includes the following. In California, you or your spouse must have lived in the state for at least six months before filing. In the county where you are filing, you must have resided for at least three months. The divorce process is complicated. If you are contemplating divorce, you should understand how it works. California legislation governing divorce does not require proof of fault. It is not necessary to prove that your spouse caused the divorce. Your divorce can be granted without providing a reason if you and the other party agree. If you are litigating custody and visitation, evidence of fault may be introduced. One spouse must file a petition for divorce to start the legal divorce process. The petition can be filed at the district court where you or your spouse reside. The petition asks the court for a divorce. The petition identifies both spouses. The other spouse is the respondent. It may include a list of the couple's children and any problems like custody and support. Domestic Violence Restraining Orders, or DVROs, restrict the parties' actions if there has been some type of domestic violence, harassment, or the dread of such. Domestic Violence Restraining Orders are available from the California Family Court, but they are distinct from those available from the criminal court. A DVRO can be obtained in family court with flimsier evidence and is easier than in criminal court.
