Laws and Standards Governing Family Law Appeals There are laws governing divorce appeals, just like almost every other legal discipline. However, these statutory laws are non-objective, unlike other legal areas. This is because dividing two life forms or spending time with children does not go well with the rigid laws of life. In family courts, judges and magistrates have the initiative of judicial preference to decide the best outcome. Family law, does not involve juries, meaning that a case is heard just by a judge or magistrate at a hearing. This is good since the judge or magistrate who decides on your case will have a lot of options, as well as lots of factors to weigh and consider in their judgment. The appeals framework is not the same as it was when the case was initially heard. The justice system cannot operate without finality in decisions, so the laws of appeal limit how far a decision can be reviewed. The appeal factors limit the court decision can only be reviewed for abuse of discretion unless the challenge is that the judge misinterpreted or applied the wrong law. The abuse of discretion means the decision of a judge can only be overturned if it is so far from the truth that no rational mind would have made that judgment. It is hard to meet this standard. This means that you need many facts to support your case if there are any serious chances of winning. This does not mean that family law appeals are impossible, just that an attorney should look your case to see your chances of success.

I was dropped a week before my court date. I never even saw my attorneys face. I paid full paychecks to these people and it was not enough. I am a single mother of 5. This was a joke. I’m now in collections yet I never saw any real help from anyone. I did most things on my own and they want $8000. I was married for 14 years, I was not allowed to get a job or go to school. I am supporting our kids alone. He was given 3/15 months of retroactive support after throwing us out of our family home drunk and on drugs. These people are not worth what they charge. My domestic violence local chapter did more for me.
