I retained David Scott to represent me in a Florida post-divorce alimony modification matter. I was ultimately very disappointed with the preparation and strategic financial analysis I received. A significant issue in my case was my former wife's sworn financial affidavit. It disclosed approximately $6,390 per month in employment income, approximately $441,736 in net worth, approximately $148,049 in retirement assets, and a $450,000 residence with approximately $200,000 owed. At the time, I had lost my employment, had no employment income, and was relying on withdrawals from my IRA to meet my living expenses. My concern was that I did not feel my former wife's financial disclosure was thoroughly reviewed with me before mediation or that her financial circumstances were adequately incorporated into our negotiation strategy. David disagrees with my recollection and maintains that these matters were discussed with me and that I made an informed decision to settle. The case ultimately resulted in my alimony being reduced from $1,300 to $600 per month. I also paid $11,200 from my IRA as part of resolving the claimed arrearage, and I remain obligated to pay $600 per month until the agreed termination date. I ultimately accepted the mediated settlement, and I take responsibility for that decision. However, I remain dissatisfied with the level of preparation and strategic financial analysis I received leading up to it. I subsequently sought an independent legal opinion about whether anything could be done to change the settlement and was advised that the settlement is non-modifiable. Therefore, I am not writing this review because I am trying to reopen my case. I am writing it to accurately describe my experience as a client. I would recommend that anyone considering David Scott for an alimony matter make sure that all financial disclosures are reviewed in detail with them and that the negotiation strategy is clearly explained before entering mediation.
