Legal Separations In 1984, Indiana made legal separation distinct from divorce. The legal separation process allows couples to divide their lives and prepare child support, spousal maintenance, and custody without actually divorcing. Indiana courts can grant legal separation if circumstances in the marriage have made it impossible for both parties to live together, but there are grounds to keep the marriage intact.
