Moreover, North Carolina requires that both parties are separated for one year before the court issues a final decree of divorce. At least one of the parties should live in North Carolina for over six months before filing. The law does not require the separating parties to wait for the year before the court grants them a divorce. This one-year separation period gives these parties enough time to discuss all matters related to the divorce before the court gives them a divorce. The parties can file immediately after the separation to initiate the custody, support, and property division provisions (North Carolina General Statute, n.d.). This unique provision allows the parties to plan their lives without forgoing the life maintenance needs (Petition for Divorce Form, 2022). The North Carolina law also has a provision that spousal maintenance and property division should accompany the petition for the divorce before the court grants it. Failure to file these claims, you will lose that chance forever. The law anticipates that filing them before the divorce ensures the parties are not disadvantaged (North Carolina General Statute, n.d.). Please see N.C. Gen. Stat. 50-6 for more about the divorce process in North Carolina after a year of separation.
