A “protected person” is a very wide group. It is anyone that the defendant had a dating relationship with, or a child in common, or expects to have a child in common (if one of the parties is pregnant). Domestic violence is a special category of offense in NJ. It is taken more seriously than crimes committed by two strangers. This is why victims of domestic violence have round-the-clock access to the court system. They can file for a temporary restraining order at any time and the police will show them how to do this. It is also mandatory for the police to arrest a person accused of domestic violence if there is probable cause that an act of domestic violence happened AND: The alleged victim shows visible signs of an injury. There is probably cause to believe that a temporary restraining order has been violated. There is an outstanding warrant. A weapon was used. In all other cases, there is police discretion about whether to make an arrest. However, an arrest for a domestic violence offense is serious because it is automatically referred to the Superior Court, even if the case is a minor one like simple assault. And not any prosecutor in the Superior Court will prosecute the case; a special prosecutor who specializes in domestic violence cases will be assigned to the case.
