What is the process of a divorce? The divorce process began when the first party filed with the court a divorce complaint. The Ohio complaint must have the grounds for divorce. The most common grounds are incompatibility or gross negligence of duty. Incompatibility cannot be granted if the other spouse denies it. However, the parties can use this as a “no-fault” ground if they have lived apart and separate for more than a year without cohabiting. Ohio Revised Code SS 3105.01. Ohio Revised Code SS 3105.01. Because in Ohio, divorce is usually granted on the basis of incompatibility, although fault can be a factor in some divorces, very few Ohio divorces are granted. With only a few exceptions, the requirement for a court to find fault in a divorce. Little evidence is needed to prove that a divorce was sought. The other party must respond to the complaint and all the paperwork given by the plaintiff. The other party must file an answer or counterclaim to the courthouse. An answer or counterclaim usually contains the same grounds that the plaintiff has preferred against the other party. It must be filed by the respondent within 28 days after service.
