ABOUT   Services Excellence Summary

There are moments in your life when you need someone to support you and advocate on your behalf. When you are dealing with a criminal or family law matter, you need someone who is committed to your rights and will advocate on your behalf in court. Kimbrough Legal, PLLC is here to provide you the legal guidance you require to get your case to court. Tycha Kimbrough, the managing attorney at Tycha has received several industry awards for her dedication to giving clients the compassionate and practical legal advice she is known for providing. Physical Contact Simple assault is an act that harms another person intentionally, willingly, or recklessly (Justia, 2022). It does not require physical contact to be charged with simple assault. Just the threat of violence can be enough basis for a criminal conviction. The least the prosecution could prove is that there was intention, willingness, or recklessness to cause bodily harm (Justia, 2022). The assault could also involve other types of contact, such as touching someone inappropriately at work (Rummel, 2022). Physical Contact Leading to Bodily Injury If the assault results in bodily injury, it qualifies as a Class B misdemeanor (Justia, 2022). A person commits the offense if, with no legal cause and without the other person's consent, they cause bodily injury to another (Rummel, 2022). Class B misdemeanors have a one-year minimum prison sentence and a $4,000 maximum fine just like Class A misdemeanors (Justia, 2022). The charges for simple assault can be reduced to a Class C misdemeanor if the defendant only threatens to cause bodily injury or makes physical contact with someone who provoked the defendant (Rummel, 2022). The offense attracts a lighter penalty than when there is bodily injury, but there is no mandatory jail sentence (Justia, 2022). However, there is still a considerable fine.
