About this Personal Injury Settlement Calculator

This calculator uses the multiplier method, the starting point most insurance adjusters and personal injury lawyers use. It adds your financial losses (medical bills and lost wages) to a pain-and-suffering figure, which is those losses multiplied by a factor set by how serious the injury is: 1.5 to 2 times for minor injuries, up to 4 to 5 times for catastrophic ones. The type of accident adjusts the result, and it is then reduced by your share of fault under Washington law.

Washington rules this calculator applies

Fault rule
Pure comparative fault. Your payout drops by your share of fault, but you can still recover even if you were mostly at fault.
Deadline to file
You generally have 3 years from the date of the injury to file a personal injury claim in Washington. Claims against a government body usually need formal notice much sooner, and medical malpractice and wrongful death claims can have their own deadlines.

General information about Washington law, not legal advice, and the estimate is not a guarantee of any outcome. A lawyer can tell you how these rules apply to your case.

Frequently asked questions

10 questions
How is my personal injury settlement calculated in Seattle?
The calculator estimates economic damages and pain and suffering using a multiplier on medical costs, adjusted for accident type and fault under Washington law.
What affects the accuracy of a personal injury settlement estimate?
Accurate estimates depend on complete medical documentation, clear accident details, and understanding of fault. Estimates are general and may differ from actual settlements.
How does Washington's fault rule impact my settlement?
Under pure comparative fault, your settlement is reduced by your share of fault, but you can still recover damages even if mostly at fault.
What is the deadline to file a personal injury claim in Washington?
You have 3 years from the injury date to file a general negligence claim in Washington. Different rules apply for government claims and medical malpractice.
Should I accept the first settlement offer from an insurer?
It's common for initial offers to be lower than what may be recoverable. Consider consulting with a legal professional before accepting any offer.
How long do personal injury settlements take in Seattle?
Settlement timelines vary based on case complexity and negotiations. Some resolve in months, while others may take longer, especially if litigation is involved.
What medical documentation is crucial for my injury claim?
Important documents include medical bills, treatment records, and doctor's notes detailing injuries and prognosis. These support your claim's validity and value.
How do lawyer fees affect my net settlement amount?
Contingency fees, typically 33% to 40% of the settlement, are deducted from your award. Free consultations are common to discuss potential fees.
What factors increase pain and suffering compensation in Washington?
Severity of injuries, impact on daily life, and recovery duration can increase compensation. The multiplier method estimates this based on medical costs.
Does Seattle's cost of living affect personal injury settlements?
While cost of living isn't directly factored, higher local medical costs and lost wages may influence the economic damages portion of a settlement.
