About this Severance Pay Calculator

Severance in Canada has two layers, and this calculator shows both. The first is the statutory minimum under the Alberta Employment Standards Code: a fixed number of weeks of notice or pay in lieu, set by your length of service. It is the least your employer can legally give you, and it is often what the first offer is based on. The second is common-law reasonable notice, which is what a court would usually award a non-unionized employee without a valid termination clause. Courts set it from the Bardal factors: the character of your job, your length of service, your age, and how hard it will be to find similar work. The common-law figure includes the statutory amount rather than adding to it, and it rarely goes above 24 months.

Alberta rules this calculator applies

Statutory notice
1 week after 90 days, 2 weeks after 2 years, 4 weeks after 4 years, 5 after 6 years, 6 after 8 years and 8 weeks after 10 years.
Severance pay
Alberta has no separate statutory severance pay on top of notice; the extra money comes from common-law reasonable notice.
Common-law notice
Usually longer for older employees, senior or specialized roles, and people recruited away from secure jobs. Short-service employees often receive proportionally more than the "one month per year" rule of thumb suggests; long-serving senior employees usually top out around 24 months.
Termination clauses
A valid termination clause in your employment contract can limit you to the statutory minimum. Whether a clause is enforceable depends on its exact wording and on provincial case law, which is why it is the first thing an employment lawyer checks.
Federally regulated work
Applies to federally regulated employers: banks, telecoms, airlines, interprovincial trucking and rail, and federal Crown corporations. These employees fall under the Canada Labour Code instead: 2 weeks of notice after 3 months, then 1 week per year of service from 3 years to a maximum of 8 weeks, plus severance pay of 2 days' wages per year of service (at least 5 days) after 12 months.
Duty to mitigate
You are expected to look for comparable work. Income earned from a new job during the notice period can be deducted from what a court awards.

General information about Alberta employment law, not legal advice, and the estimate is not a guarantee of any outcome. Unionized employees, dismissals for just cause, fixed-term contracts and valid termination clauses can change the answer. An employment lawyer can tell you how these rules apply to you.

Frequently asked questions

9 questions
How does the Edmonton severance pay calculator work?
The calculator estimates severance by considering age, job type, pay, and service length. It shows Alberta's statutory minimum and a common-law notice range.
What is the difference between statutory and common-law severance in Alberta?
Statutory severance is a set minimum notice period. Common-law notice, based on Bardal factors, is usually longer and considers employment character, age, and job availability.
Can my severance increase if I was recruited away from another job?
Yes, being recruited away can increase common-law notice as it affects the Bardal factors, potentially leading to a higher severance estimate.
Should I sign the first severance offer I receive?
Signing a severance offer usually means giving up further claims. Consider the offer carefully, as it might not reflect your full entitlement.
What if I am fired for cause in Alberta?
If fired for cause, you may not be entitled to severance. The employer must prove serious misconduct to justify this.
Do unionized employees in Edmonton get severance pay?
Unionized employees' rights come from their collective agreement, not common-law notice. Severance terms are negotiated through the union.
What severance applies to federally regulated employees?
Federally regulated employees follow the Canada Labour Code, which includes notice and severance pay based on service length.
What is the duty to mitigate in Alberta?
Dismissed employees must seek comparable work. Income from a new job during the notice period can reduce the severance owed.
How accurate is the severance estimate for Edmonton?
The estimate provides a range based on common-law principles and statutory minimums. Individual cases may vary based on specific circumstances.
