Six months is the waiting period under California law, meaning that marital status can be terminated no earlier than six and a half months after the date the Summons was served by the Petitioner to the Respondent. The divorce/dissolution is initiated by filing a Summons and Petition. The Petitioner is the person who files the lawsuit. The opposing party is called the Respondent, and this will be true regardless of which party brings an issue before the Court and requests an order. If there are children from the marriage, a Declaration Under Uniform Child Custody Jurisdiction Act (UCCJEA) must be filed with the Summons and Petition for Dissolution. This paper will identify the children, where they have lived for the past five years, any prior custody cases, any family law or criminal restraining orders, and if there are any other people claiming children’s custodial rights. The Court will issue a Notice of Calendar Setting when the divorce action is filed. This will set the case for the Status Conference. A Status Conference is an administrative hearing by the Court where the parties or sometimes their attorneys, if the parties are represented, give the Court an update on the current status of the case. This includes when the dissolution was filed and served to the respondent. Status Conferences will be scheduled until the Court has issued a judgment of dissolution.
